FROM ROMAN LAW TO THE PRESENT: LEGAL CAUSE AND SYNALLAGMATIC RELATIONSHIPS

Roman Law forms the foundation of the Continental European legal system. This is the most apparent reason why Roman Law maintains its importance today. In this context, the legal reasoning and cause-and-effect relationship, which contemporary contract law primarily seeks in a legal relationship, can be traced back to the period of Roman Law. Although the concept of legal cause (causa) has been a fundamental building block of legal relationships from the past to the present, it is one of those concepts whose definition has not been firmly established. The fact that there are multiple definitions of the legal cause, which is a basic concept that must be understood to explain a legal relationship, has led to its broad interpretation and confusion with other concepts. For these reasons, there has arisen a need to examine the development of the concept of legal cause from the past to the present.
